Business Skills – Changes to Senior Manager definition

waFrom the 1 July 2009, DIAC will be changing the policy relating to the senior manager provisions of the State/Territory Sponsored Business Owner subclass 163. The purpose of the policy changes is to enable applicants & migration agents to prepare visa applications where the the main visa applicant does not own a business but has the relevant skills and experience to own and operate a successful business in Australia. The new changes will clarify the definition of a “senior manager” in relation to management experience, relevant experience in absence of formal qualifications and management duties relating to the day to day running of a business.

The relevant clause covered by these changes is clause 163.111 and subclass 163.212(b) of the Migration Regulations 1994 and defined in Section 9 of PAM3 Sch2 Visa 163.

    Hi Mege

    Would be really grateful if you could shed some light on our situation.

    We applied for a 163 Sponsored visa (Snr Manager category), Qld (through an agent).

    Our Case Officer reviewed our application and requested more information relating to the company where my husband currently works as a Senior Manager.

    Our response/reply was submitted on 10 March 2010 (almost 2 months ago) and to date, we have heard nothing. Is it unusual for the Case Officer/s to take this long in making their decision once they have started working on an application?

    I do not want to put pressure on my agent as I know that the outcome of the application is out of their hands – but the uncertainty of this waiting game is taking it’s toll on us!

  • Hi Marie,
    There is a cap on business visa approvals until after 30 June 2010. Also have you done your medical and police checks?
