The grant of a Australian Provisional Business visa is not an automatic entitlement to permanent residence in Australia. To obtain permanent residence in the Business skills visa category, you will be required to lodge a seperate application before your provisional visa expires.
For subclass 890, 892, 845 and 846 applicants must meet the minimum turnover requirements for their nominated visa and demonstrate the following ownership interests in their businesses:
- 51% where the business turnover is less than A$400,000;
- 30% where the business turnover is A$400,000 or more; or
- 10% where the business is a publicly listed company.
The followings visas are available for holders of Provisional Business visas.
Subclass 890 Business Owner visa
Subclass 890 Visa requirements:-
For at least 2 yeras immediately before the application is made you must have:-
- had a continuous ownership interest and management role in an actively operating main business in Australia; and
- spent a cumulative total of at least 12 months in Australia in the 2 years immediately before the application was made
Also through the 12 months immediately before the application is made:-
- your nets assets in your main business/es in Australia must be at least A$100,000; and
- your annual turnover of your main business/es in Australia must be at least A$300,000; and
- your main business/es must have employed the equivalent of at least 2 full time employees who are Australian citizens, permanent residents or New Zealand passport holders who are not members of your family unit; and
- the total net asset value must be at least A$250,000.
- spent a cumulative total of at least 12 months in Australia in the 2 yeras immediately before the application was made
Subclass 892 State Sponsored Business Owner visa
Subclass 892 Visa requirements:-
- You have owned and managed an actively trading business(es) in Australia for at least 2 years before making an application;
- You have been resident in Australia for a total of at least 12 months during the last 2 years;
- Your business had turnover of at least A$200,000 during the last 12 months; and
- You meet at least two of the following:
- You have held net assets in your nominated business(es) of at least A$75,000 during the last 12 months;
- You have held total net assets in Western Australia of at least A$250,000 during the last 12 months; or
- Your nominated businesses employed the equivalent of at least one full time employee during the last 12 months (Australian citizens or permanent residents).
Subclass 893 State Sponsored Investor visa
This visa is available for holders of the 165 State Sponsored Investor (Provisional) visa.
Subclass 893 Visa requirements:
- You were the primary applicant for your 165 visa;
- You have held your Designated Investment for at least 4 years OR your investment is due to mature within the next 3 months;
- You have been resident in Australia for a total of at least 2 years out of the last four years; and
- You have a genuine and realistic commitment to maintain a business or investment activity in Australia.
