<p>As of 19 April 2010, the Australian government  made several major changes to its business visa migration programme to take effect immediately.</p>
<p>This changes were made after the Australian government considered comments and feedback from State governments bodies like Western Australia and Queensland who sponsor the majority of business visa application.  The main reasoning for the changes were that they would promote benefits to the Australian economy such as job creation and also improve the integrity of the visa system.</p>
<p><strong><span style="text-decoration: underline;">Increased net assets</span></strong></p>
<p>Any Australian business applicant wanting to apply for a State sponsored business owner visas subclass 163 or a State sponsored senior executive visa subclass 164 will now need to have a minimum net asset level of AU500,000.  Previously the minimum requirement was AU$250,000.</p>
<p>Any Australian business visa applicant wanting to apply for a Business owner visa subclass 160 or Senior executive visa subclass 161 will now need to have a minimum net asset level of AU$800,000.  Previously the minimum requirement was AU$500,000.</p>
<p>The increase is apparently due to increased cost of living and doing business in Australia.</p>
<p><span style="text-decoration: underline;"><strong>Increased business ownership</strong></span></p>
<p>Previously, Australian business visa applicants who were relying on business ownership interest, were required to show at least 10% ownership share in their main business.  As of today, the following will apply:-</p>
<p>1. Where business turnover is AU$400,000 or less, an applicant must have at least 51% ownership interest.</p>
<p>2. Where the business turnover is above AU$400,000, an applicant must have at least 30% ownership interest.</p>
<p>3. Where the business is a publicly listed company, an applicant must have at least 10% ownership interest.</p>
<p>This amendment applies to all business owner visas (subclasses 132, 160, 163, 890, 892, 845, 846) and applies to the definition of ‘main business’ at Migration Regulation 1.11.</p>
<p>A transitional provision will be available for onshore visa applicants who have purchased a business in Australia prior to the change and are applying for a permanent onshore business owner visa (subclasses 890, 892, 845, 846).</p>
<p><strong><span style="text-decoration: underline;">Senior Manager option removed</span></strong></p>
<p>As of today, 19 April 2010, Australian business visa applicants will not be able to apply under the Senior manager option.  Due to fraud and integrity issues with past applications this option has been removed from the Australian business visa system.  For senior managers of major overseas business, option of a Senior executive visa may be viable given the change or employer sponsored visa.</p>

<li>You have a successful business ownership and management background.</li>
<li>Your net asset level is at least A$500,000 plus an additional amount for your settlement costs in Australia</li>
<li>You have not been engaged in a business where the provision of professional, technical or trade services took up more than 50 per cent of your time</li>
<li>You have a genuine commitment to engage in business activities in Australia and has demonstrate that Australia will benefit economically from the proposed business or investment</li>
<li>State sponsorship approval</li>
</ul>

<p>Rankings released by CommSec, the sharetrading subsidiary of the Commonwealth Bank, named Western Australia as the country&#8217;s best performing economy.</p>
<p>The Western Australian economy is powering along thanks to ongoing Chinese demand for resources, and the state is not expected to be knocked off its perch in the near future.</p>
<p>The next three years will be stronger than previously thought, rising to 4.5 per cent in 2010-11, 5.5 per cent in 2011-12 and 6.25 per cent in 2012-13, according to a report released by the Chamber of Commerce and Industry. This figure is much higher than previously expected.</p>
<p>Economists are surprised and are scrambling to update their growth forecasts as companies dust off their expansion plans sooner than expected after a downturn that had threatened to send the resource-dependent state into a deep recession.</p>
<p>The West Australian Chamber of Commerce and Industry announced that it has ramped up its economic growth forecasts for the state for the second time in just three months.</p>
<p>Western Australia is getting income from the economic growth made by local businesses, with investment improving and looks to expand in the favorable economic climate.</p>
<p>There is a big increase in consumer spending, as households feel more confident about splashing out on &#8216;non-essential&#8217; items like new cars, meals and consumer electronics.</p>
<p>“Western Australia&#8217;s prospects were the strongest of any Australian jurisdiction”, says CommSec chief economist Craig James. &#8220;Western Australia still appears to have the best prospect of all the states and territories, benefiting from strong demand for resources, especially from China, and, more broadly, Asia”.</p>
<p>The Chamber of Commerce &amp; Industry reported that business investment is expected to grow by 7 % in 2010-11, picking up to 9.75 % in 2011-12 and 12 % in 2012-13 as construction begins on planned projects worth up to $200bn. Its previous forecast of a 5.25 % contraction in business investment in 2009-10 has been revised up to a 2 % contraction, reflecting the rapid turnaround in business confidence.</p>
<p>The mega-projects on the way in the state include the $43bn Gorgon liquefied natural gas development on Barrow Island, where early construction has begun, and Woodside&#8217;s Pluto gas project near Karratha, which is to start exporting early next year.</p>
<p>The Chamber of Commerce &amp; Industry has also lifted its forecast for exports given that demand has remained &#8220;surprisingly strong&#8221; during the downturn.</p>
<p>Exports grow this year with volumes holding up and commodity prices beginning to rise, as opposed to its earlier forecast.<br />
But the impact of the slowdown is still being felt in employment, which is expected to grow by just 0.25% during 2009-10.</p>
<p>The unemployment rate in Western Australia is also going down, in fact it was 5.7% in the last quarter of 2009, and now it is expected to drop 3% by the end of 2012/13.</p>
<p>&#8220;With the booming Western Australian economy, it is essential that skills requirements are met in order to avoid a massive skills shortage&#8221;, commented by the Western Australian Business News.</p>

<p>An Australian Investor visa maybe an option for you.  There are 2 types of visas int he Australian business investor category:-the State sponsored Investor visa subclass 165 and the Investor visa subclass 162.  Both are provisional visas are granted for a period of 4 years.  After this period, a visa holder is then able to apply for the permanent business investor visa, known as the state sponsored Investor visa subclass 893 and the Investor visa subclass 891.</p>
<p>Before you can begin to plan your move to Australia you have to take care of the visa/immigration aspect.</p>

			<content:encoded><![CDATA[<p>Recently I was contacted by someone who was a sub class 163 visa holder.  She and her children had acquired this visa through a successful application for a subclass 163 visa application by her husband, who is the main visa holder.  The family was now in Australia and the wife, let&#8217;s call her Betty was wanting to study at Tafe.  To digress for people not familiar with Tafe, it is an Australian post secondary instituion offering technical and further education/vocational training.  Tafes have grown in stature over the years since its formation and their quality of training is on par with university education.</p>
<p>Anyway, Betty wanted to study at Tafe but was wondering if as a sub class 163 visa holder she would be classed as an international student and whether the fees would be higher because of this.</p>

<p>I advised her that as she was the holder of a provisional sub class 163 business visa, a temporary visa in effect, she would be deemed as an international student for the purpose of Australian tertiary study.  International students fees are significantly higher than domestic fees.  The promotion of Australian education to overseas student is big business bringing millions of dollars of revenue to universities and colleges throughout the country.  Only Australian permanent resident visa holders are entitled to pay domestic student fees to Ausralian education bodies like Tafe.</p>
<p>As a basic rule most provisional or temporary skilled or busiess migrant visa holders would be classified as international students if they wish to study for a post secondary qualification at an Australian college or university.</p>
