Off List Nominations – Skilled Regional Sponsored (Provisional) visa Subclass 475

The Skilled Regional Sponsorsed (Provisional) visa sub class is the least favourite of the skilled visas.  From my own experience I never enjoy advising someone that this is their only choice…what a choice!   Even though its a way into Australia, this visa category asks a lot of the average migrant.  Most migrants are so enthusiastic about living in Australia, its a dream they have but this particular sub class visa is a bit of a slap in the face and takes the shine of the dream.  The visa has multiple layers of demands:-

1.  You need sponsorship from a State who will have their own requirements to satisfy before giving you in the sponsorship

2.  The particular State may not want to offer nomination for your particular occupation so therefore its list of occupations in demand will reflect this

3.  You may need to reconsider your choice of State because the migration lists don’t favour your occupation

4.  Once this is resolved, and you have acquired sponsorship and made an application then the most challenging aspect is going to live in a regional part of Australia (not the Perth or Brisbane that featured in the dream)

5.  Worse yet what if your occupation is on none of the states’ lists, what can you do?

For anyone stuck in the purgatory of scoring between 90 points in the points test, with an occupation that isn’t on the demands list of the State in which they want to live, what can they do.

Firstly, I think you really have to have the stamina after going through the above scenarios but here are some things to think about:-

1.  Most states may consider an application for sponsorship, if you also have a job offer.  It’s not a given, but you can check this by using the following link to check their websites. http://www.australia.gov.au/State_&_Territory_Migration_Sites

Obtaining a job offer is not an easy process but if you can do it, good for you.

2.   This option is by far the best and actually gives a potentional sub class 475 hope of making an application for a Skilled Sponsored sub class 176 visa, a permanent visa option.  I’m referring to the “off-list nomination”.  From time to time certain states decide to offer a scheme where if an applicant’s occupation is on the DIAC Skilled Occupations list but not on the state Occupations in demand list, the state migration unit may still consider the applciation as an off-list nomination for the sub class 176 visa.  Western Australia is one state currently offering this scheme Check out their website for more info http://www.migration.wa.gov.au/?page=skilled-migration . They offer up to 500 spots under this scheme.

It’s important to note that skilled migrants seeking State Sponsorship for an off-list occupation must meet the general DIAC skilled visa criteria and the particular’s state.  In the case of Western Australia, more consideration will be given to applicants who:

  • have a job or offer of employment in Western Australia on the list of skilled occupations;
  • have established links to the State – living, studied or have support in Western Australia;
  • demonstrate that their occupation is in demand in Western Australia; or
  • are prepared to live and work in a regional area of the State.

Off-list nominations are normally on a case-by-case basis.

Good luck,

Mege Dalton

My job is not short skilled occupation. I work as a normal team member in distribution center. I want to try the off list nomination. Is it possible. I’m just wondering whether I’m eligible to get permanent resident or not.
Cheers

Hi Ben,

Good for you studying as well as working for Coles. Why don’t you send me your details and I can give you a free assessment regarding your eligibility for either the onshore student permanent visas subclass 885 and subclass 886. I don’t prepare onshore visa applications as I am based in Dublin but would be happy to at least give you a migration agent advice on your eligibility so you can feel more secure with this knowledge.

Please send me:-
1. Your date of birth
2. Current visa details i.e student visa, skilled graduate visa etc
3. How long till you graduate and what qualification will you receive i.e degree qualification
4. Whether you have sat an IELTS test recently, if so, what were your results

Kind regards,
Mege Dalton

Hi Mege,

You are so nice to show light to our dream to live and work in Australia. I am from Asia. I have a first cousin living in western Australia who will sponsor me for 475 subclass visa category. He is living at designated area. It is so great that we are benefiting from your advice. I heard from my friend that subclass 475 is not in the priority list of DIAC. They take long 2 years for processing 475 subclass visa. Am I right? They do not think people sponsored by relatives are really skilled. I have around 12 years working experience in development sector (NGO). I am not sure if my present work is on the demand list of skilled occupation list. Besides I am in a bit of confusion about my age. My date of birth is 12 January 1965. Am I below 45? Am I eligible for application? Do you think I should apply immediately if I get sponsorship from an eligible relative?

with kindest regards

F. Ahmed

Hi Neemu,

In order to check out which states will sponsor you and what their requirements are, I highly recommend you go to their particular websites. http://www.australia.gov.au/topics/immigration/state-and-territory-migration-sites

Most states now have online application system which makes the process efficient and user friendly.

Kind regards,

Hi Mege.

Firstly, thank you for this information and for answering our queries.
I am looking to immigrate to South Australia via the off-list permanent 176 visa. I have done my IELTS (7) and my VETASSESS assesment. I have an employment offer, but am unsure as to some of the requirements. Do you know of any salary requirement that there may be? i.e: Is there a minimum salary offer requirement from the sponsoring employer?
And how long do these visas usually take to go through?

Kind regards,
Brett Petersen

Hi All,

I have started my immigration process later 2008 with a certified agent. Am now surprised he tells me that my occupation Business Profession if offlist. In my contract, the profession subject is “Business & Information Professional” . Am actually an HR Manager since 26 months now, however in my contract the HR Manager JD is the one written in the contract beside the “Business & Information Profesisonal”.

My options were the 475 which now my agent says it is offlist although I understood that he reserved a place for me earlier!! He wants me to hit for the other option of 176 as my husbans’s aunt is an australian citizen; but am not sure on her willingness to sponspor our family.

- My question is that, is really the above profession in offlist ?
- Also, I was working as an office Manager since 1997 until 2007. Can I use this profession to apply as I can see it still on the SOL.
- My IELTS score was R:8 W:6.5 L:8 S:6.5 overall 7.5.

Regards,
Hedy
