Order of Processing for Skilled Visas Applications
In December 2008, the Department of Immigration and Citizenship (DIAC) changed the order of processing of visa applications under the General Skilled Migrant programme. It introduced the Critical Skills List, a response to fulfilling the needs of the Australian economy and giving scope for state and territory governments to meet critical skills shortages in their jurisdiction. This list is being used to prioritise certain visa applications as of 1 January 2009.
The current order of processing for Skilled visa applciations is now as follows:-
1. Applications for State or Territory Government sponsored visas i.e State Sponsored Regional visa Sub class 475 or State Sponsored Skilled visa Sub class176
2. Appications where the nominated occupation is on the Critical Skills List http://www.immi.gov.au/skilled/general-skilled-migration/pdf/critical-skills-list.pdf
3. Applications where the nominated occupation is on the Migration Occupations in Demand List
4. All other visa applications

Thank you for your enquiry.
For 475 visas, general processing times can take between 6-12 months.
For 176 visas, gneral processing times from 6-12 months.
There a no exact times lines to the visa process. Evening though processing times are not within the control of the applicant, they should make every effort to provide any required documents as efficiently as possible to facilitate the process.

6-12 months is the general processing time for the sub class 475 visa. Currently the Department of Immigration is only processing Skilled visa applications which are state or territory sponsored so this could possiblly extend the general processing time.

No the occupation is not in the critical list. This is a Class VF Subclass 475 Skilled (Provisional) Regional Sponsored and is sponsered by my relative in Melbourne a designated area.
HI I just checked the below weblink where under the caption “Australian Government announces changes to skilled visa intake” It states that “Applicants sponsored by eligible family members or a state or territory government will still receive priority processing, regardless of occupation”.

I had applied for subclass 475 and my file was logged on 4 Aug. 08 with DIAC, recently i made post lodgement inquiry with DIAC and come to know that my file is yet awaited to be allocated to a case officer as DIAC haven’t received from no. 1100 of state sponsorship, In this regard made inquiry with South Australian migration department and come to know that they had already send it in the month of Aug 08 . Again on my request they send it to DIAC mentioning TRN number on it on 10 March 09 it is again not received by DIAC even after a month. So please suggest me what i can do in this regard as its their internal matter. I had also sent the copy of state sponsorship from my side.

Your problem seems more like a communication issue between the SA government & DIAC. If you have sent a copy of your state sponsorship form than you should be confident in the knowledge that DIAC at least has your copy on its file. You just need to wait now for further processing.

Thanks for your reply, Yes I agreed with you that DIAC had a copy of state sponsorship which i sent them. But the main concern over here is that they had mentioned that until unless they receive state sponsorship from SA Govt side till then they won’t allocate my file to case officer. It is going to be about 9 months and no case officer is yet allocated so kindly tell me how much time more it will take. If i can do something like complaint to DIAC, if i can then if it would have any negative impact on my file.

Hii, I applied for the Visa sub class 475, I got the sponsorship from SA and case officer is already allocated for my application I also submitted my medical result to DIAC, Can you please help me to know how much time they will take more to finalize my application?
This is a GSM Subclass 475 Skilled (Provisional) Regional Sponsored and is sponsered by my first cousin in Melbourne, a designated area. My occupation is not in the critical list. My application has been lodged as an e-application. Earlier the anticipated processing period was 6-8 months for this visa, but now as the rules and priorities are changed, I want to know that what is the lengthened processing period. Sorry but no I can’t tell you how much time it will take to finalise your application. I am getting lots of posts from people wanting to know if I can predict the time it’s going to take for the applications to be processed. As far as I can go with giving you an idea is to say that the Department of Immigration is priority processing sponsored skilled visas like the 475, and these could take up to 12 months from date of lodgement.
I would like to invite you to post a further comment when you do get your visa approval advising your visa sub class applied for, your date of lodgement, date you did your medicals and the date your visa was granted. I would invite anyothers awaiting a visa approval to do the same so that others in a similar situation may be able to get an idea of timing.

I don’t think family sponsorsed skilled visas are being given the same priority processing as statement or territory sponsosrhsip skilled visas.

I would not like to second guess your own agent’s advice. You really should ask your agent for the reasons behind their advice that your application is not on the priority processing list. Professionally it would not be proper of me to contradict any other agent’s advice to their client and also I don’t have all the information available to me about your case.
Suffice to say, only occupations in very high demand make their way on to the Critical skills list and hence priority processed if all other elements are in place i.e sponsorship. The key is the nominated occupation one has.
Please go back to your agent, I am sure they would be happy to fully inform you.

I have submitted my application for visa 176(sponsored by a relative) this month, and received the confirmation email from the Australian Immigration that they have received my application.
I am aware that the processing time is 12 months for my application(have given all relevant documents to the department).
My question is, what should I be preparing further before I come onboard to Australia? E.g: get details about the culture/people, relevant introductory training let it be professionally or personally or etc.

Thankyou for your post. I think it’s a very good idea to do your research into Australia culture to familiarise yourself with the country you will be migrating to. There are so many resources on the web that you could avail of, just typing in Australian modern history into google will bring up a myriad of resources you can read about how Australia was first settled, the past history with the aborigines and their culture, important historical figures in Australian history in relation to politics, arts & culture, economy etc.
You may also like to begin reading Australian newspapers from time to time. This is a link to a variety of online newspapers http://www.onlinenewspapers.com/australi.htm
This would help you get an idea of current situation in Australia and familiarise yourself with what is going on in the particular state/town you intend to live in.

My naominated occupation is “Education officer”.
I have applied for this visa soon after i received state sponsorship from South Australian government.
when i applied for state sponsorship my nominated occupation was on demand list. but when i applied for visa my nominated occupation was removed from the demand list. When i asked my agent about this he said, since u received ur state sponsorship you need not worry about anything with regard to the nominated occupation being removed from the demand list and i can very well apply for visa.My question is
will it affect my visa suceess? will they give visa only for those whose occupations are on the demand list? or since i received state sponship they would process my visa?. please kindly advice on this. and also tell me when will i possibly receive my visa?

It’s very difficult to say but it could be 12 months or longer given the current changes to Australian immigration policy. You can read from other posts here that applicants for sponsored visa categories like the sub class 475 are being given priority processing.

Thankyou for your question to this forum.
It sounds like you would need to apply for a student visa to enable you to study the diploma course in Australia.
What country are you residing in at the moment. If it isn’t Australia, than you would be making an offshore applicatoin for a student visa, most likely a Higher Education student visa sub class 573. There are no particular requirements to meet at the time of the application, but at the time of decision you must have proven that:-
1) you are enroled in an acceptable course of study at an Australian tertiary instituation
2) you meet requirements as a genuine student visa applicaqtion by satisfying requirements in relation to English ability, financial capaity and other matters.
3) you have acceptable health insurance
4) you satisfy health and character requirements.
Once the Department of Immigraiton is satisfied that you meet all the requirements you should be granted a sub class 575 student visa.
Please note if English is not your first language, I would highly recommend that you use a registered migration agent to assist with applying for a student visa.

I filed my application (e-filing) under clause 475 (SIR visa) sponsored by SA in the category of internal auditor on 6th dec.07. I hv a case officer but even after 18 months my case is not finalised.
When i applied internal auditor was there but at present it is neither in CSL,State skill shortage list of SA nor modl. I hv required points.
will my case be considered positively or it will be taken up as and when there is requirement (in the list) or is the file kept aside. Becoz it has taken longer than expected (one and a half year) at least i should get some answer now.

many thanks for your answers it was really helpful .Let me explain my case for you more specifically I have applied for skilled visa as accountant because I have bachelor degree in accounting ,I have scored 0.6 as overall band score in ILTES test ,I am residing in south Africa at the moment .my nominated occupation is only in demand I have a chance to get sponsorship by some state but as I explained I have already lodged my application for skilled visa 175 .do you think it is better for me to apply for state sponsorship to get priority finalizing my application ?,how long the processing time for student visa application?, if I get student visa to Australia can I change my application for skilled visa from offshore to onshore? .

You should consider applying for state sponsorship and changing your application to a sub class 176. State sponsorship applications are given higher priority of processing than sub class 175 visa applications.
Student visa applications do not take a long time to process depending on where you will be lodging the approximate time can vary between 3-8 weeks.
An onshore skilled visa application is for applicants who have studied and completed an eligible Australian qualification – this would not be your case until you had completed your Australian course and been awarded the qualification award.

Thankyou for your query on this forum. It does seem like a very long time that you have been waiting for a decision. I can only hypothesize that your application has become caught up in the DIAC processes (between the old policy of processing and current priority processing procedures put in place plus less case officers to handle case loads).
If you calculate that you have the necessary passmark for the 475 (minimum of 90 points) despite your skilled occupation not being on the MODL than you should remain positive about the chances of your application.
Hopefully your application will get carried through with the priority processing being given to state sponsored applications but I would recommend you try to make contact with your DIAC case officer to enquire. If it’s been 18 months since you lodged the application they shouldn’t mind you trying to get some feedback.

Let me tell u that after a long wait, in March 2009 I enquired with DIAC about my case. I got a reply telling that -
“i have a case officer and he is awaiting the completion of checks that has been initiated and presently no further documents are required. If anything required further, they will contact me.”
Its almost two months that i got this reply. There’s no further movement and thats why i m little upset and confused. What does it mean.

Thanks for your post. It sounds like you have applied for a subclass 176 – am I correct?
As you may know sponsored visas are being priority processed, with state sponsored and employer sponsored applications being given first preference.
I can not tell you how longer until you hear from a case officer. You need to send an enquiry via the immigration website to check if you case has first been allocated. This is an important first step in the visa processing journey.
There isn’t really a way to make the process faster.

Try to be patient – At least you know that your application has been further processed and nothing more is required. That is a better position than many other visa applicants who are still waiting for for their cases to be allocated.

I applied for the South Australian State Nomination as a Health Information Manager and received state sponsorship from SA Government one month ago. I was given 60 days time to apply for visa to DIAC. I was very busy and could not arrange all the documents to apply for visa to DIAC. It’s OK now and I’m having all the documents in hand. and still am having few days left from 60 days time-frame.
But I’ve found that although am having the State Government Sponsorship from SA Government, they don’t have this occupation on their provisional sponsorship list anymore.
My query is, as I’m already having the State Government Sponsorship and as the deadline to submit for visa to DIAC is not over yet, am I still eligible to apply for the visa to DIAC whereas this occupation is not on the SA Government list anymore ?

I haven’t had this situation happen with any of skilled visa clients but if I had to make an educated guess I would think that you should still be able to lodge your application relying on your SA sponsorship. This view is based on the fact most states are participating in off list nominations scheme which is for applicants may not have an occupation on that state’s list.
You should also contact the SA migration section & get their advice as well before lodging but do it quicky before your 60 days are apart.
For everyone else out this a lesson to act quickly when you have deadlines in your visa process,things can change.

I have got the South Australia State nomination (Skilled – Regional Sponsored (Provisional) Offshore Visa (Subclass 475) few days ago. But, my IELTS Score is Listening 6, Reading 5.5, Writing 6.5, Speaking 7.0. Overall – 6.5. I was preparing to pay TAFE Adelaide 2,500 AUD to fulfill DIAC requirement of Concessional Competent English.
Very recently, I’ve seen in DIAC website ( http://www.immi.gov.au/skilled/general-skilled-migration/pdf/gsm-faq.pdf ) the following information for Concessional Competent English :
“1. The change will affect applicants for the offshore Skilled – Regional Sponsored (Subclass 475) visa from 1 July 2009, and the onshore Skilled – Regional Sponsored (Subclass 487) visa from 1 January 2010
2. For the provisional GSM visa subclasses, the threshold English language standard will be raised from an average score of IELTS 5.5 to an average score of IETLS 6.0 for those applicants claiming Concessional Competent English.
3. All new applications for the offshore Subclass 475 visa lodged from 1 July 2009 will be affected. The onshore Subclass 487 visa will be changed from 1 January 2010.
4. In recognition of the increased language requirements, when the change is introduced for applicants for the Subclass 475 visa on 1 July 2009, they will not be required to enrol in an English language training course if they are claiming concessional competent English as is currently the requirement.”
According to paragraph no 2 & 4, as my average IELTS Score is 6.5 (>6.0) and as I am planning to apply on 01 July, 2009, do I need to enrol in TAFE Adelaide for English Language Training Course ? If, no, I can save this AUD 2,500.00.
Is there any opportunity for DIAC to make a major change in SOL list effective from 01 July, 2009 ? As I am afraid that although I can apply now, I am not doing that to save AUD 2,500.00. But, meanwhile, if DIAC make any major change in their SOL list, will it effect my application although having SA State Nomination?
And, another question is, how long does it really take to get the Skilled – Regional Sponsored (Provisional) Offshore Visa (Subclass 475) ?

First of all, I don’tknow how long ittakestothe get the sub class 475.
Secondly, your IETLS scores all meet the minimum 6.0 except the 5.5 for reading. Why haven’t you sat IELTS again and tried to improve your score? This would have been easier to do and considering you have good scores, it’s likely you could have improved your score.
In any case you have left it very late. No one can predict when or how DIAC changes the SOL, if it does and your occupation is removed you have missed your chance to apply.

I planned to apply visa 176 under family sponsorship before 1 July 09. Im in profession of Accountant & now waiting for my IELTS result. I wish I can get 7 to enable me get into CSL. Anyway, if unfortunately I unable to get that score then can I reattend the IELTS and submit the result again? Very recently I’ve heard about SA Government Sponsorship. I’m planning to apply for Visa Subclass 475. I’ve chosen my nominated Occupation as Illustrator which is still on SA Government provisional occupation list. Today I’ve applied for skill assessment from Vetassess and I requested them to send me the assessment result at an urgent basis. I’ve a application reference number from them (Vetassess). I’ve also booked for IELTS (General Training) on 27.06.09 and hopefully will get the result within two weeks time.
My inquiry here is, at the moment Illustrator is on SA Government Provisional Occupation List, but this list will be valid up to 30.06.09. I am anxious that on new Provisional Occupation List which be effective from 01.07.09, “Illustrator” occupation may be removed from the list. But, In that case I will loose my opportunity to apply for SA State sponsorship. Can I apply now for the state sponsorship ? On the online application, if I mention my application reference number of Vetassess and application submission Date which is before 30.06.09, will I be able to apply for State Nomination? Again, if I mention my IELTS Exam booking date and reference, will it work ?
I’ve been confirmed from another candidate who has already received his SA State Government Sponsorship that, after applying for nomination, SA Government normally gives 60 days to submit all necessary documents. I’m pretty much sure that within this time frame, I can arrange the Vetassess Assessment Result and IELTS Result and can submit to SA Government ?
Please let me know whether I will be able to apply for SA State Government Nomination before 30.06.09 with only reference number from Vetassess and Booking number/test date of IELTS ? I don’t wanna miss any opportunity to apply for the SA nomination.

I’m currently applying for SA state nomination. I know that it is just a temporary residence visa and it comes with obligations of staying in Adelaide for 2 years and work for 1 year before I can apply for a permanent residence visa and move freely elsewhere in Australia. There is this one question that been puzzling me – Am I allowed to work in Melbourne if I’m offered a job there while holding a SA state sponsorship visa? I have applied for 176 (family) CSL high risk country, on 27th Apr, 2009.
1. All my docs are still in “required” state and application is in “processing commenced” state from the very beginning. I have sent 2 PLE to remind my CSL applicability, but have recived no response. Is this timeframe normal or is my application being missed?

You should not panic, skilled visa applications are taking time to process and there are a lot of applications in the system. If you want a better understanding of what the Department of Immigration is priority processing, send a blank email to aspc.processing@immi.gov.au

Greetings ! Recenty I heared lots of change on immigration issue imposed on 23 September 2009.
I have loadged my application on 13 February 2009 on subcatagory 475 as a community worker but recently I have seen this ocupation is not in sponsor list of south australia.
Please let me your openion about my application. how my application will be affected and how long time may take time to be finalized ? And what you expect about future change or review of existing laws.

I have applied 176 Family sponsor visa, I haven’t front uploaded my medical test.
When I am asked for Medical test, is there a time limit for the test to be done ?

My spouse and I intend to apply under the Skilled-Independent (subclass 175) but lately I found out that Skilled-State Sponsored (subclass 176) is to be given priority during the application process. It is understood that under the Skilled-State Sponsor, I have to commit to living in Victoria for the first two years of residence in Australia. Would I have the flexibility and freedom to venture into other jobs or set up my own business in Victoria? Will my granted Victoria State Sponsored Visa get suspended half way if I decided to do something else other than my nominated occupation?
My self-assessment score at least 130 points. My job and experience is on the CSL. My IELTS score average 7 with at least band 6 from each component. Should I apply under Subclass-175 or Subclass-176?
